Qualified Opportunity Zone One-Pager Updated
Congress created the federal Qualified Opportunity Zone (“QOZ”) program in the 2017 “Tax Cuts and Jobs Act” to encourage economic growth in underserved communities through tax benefits to investors. U.S. states and territories, including Washington, DC, were nominated areas (by census tract) to be designated as QOZs in 2018, and the IRS and Treasury finalized the designations that year. 3rd Quarter Land Use Initiative Program Summary
A total of ten requests were processed. Three jurisdictions proposed short-term rental regulations (Nevada; Salem, MA; Summit County, CO). Two jurisdictions proposed regulations regarding stormwater management (Greenville County, SC and City of Fort Worth, TX). In Colorado, ballot initiative #108 proposes to amend the Takings Clause of the Colorado Constitution to require that “just compensation” be paid when private property is “reduced in fair market value by government law or regulation.” Initiative #108 is in response to ballot initiative #97 which proposes a statutory change to the setback requirements for new oil and gas development from 500 feet to 2,500 feet. NEW RESOURCE: Short-Term Rental Regulations: Advocacy Tips to Protect the Right to Rent
This resource provides REALTORS® with the basis for arguing that the right to rent is a fundamental aspect of private property ownership. The advocacy tips consist of talking points to use in opposing proposed short-term rental (STRs) regulations that would infringe upon this fundamental property right to rent. Advocacy tips are included for the following areas of STR regulations: outright bans of STRs, licensing, inspections, zoning authority, residential vs. commercial use, and local contact persons. All Business Meals Still Deductible, IRS Clarifies
The IRS released guidance to make clear that real estate professionals and others who incorporate meals into their business social events can still deduct all of their business meals under the new tax law even if the meals are part of business events whose costs are no longer deductible. The tax law enacted last year prohibits the deductibility of sporting events and other types of business entertainment, but you can still deduct meals at those events if you can separate out the costs in your recordkeeping, the IRS says. Industry groups sought the clarification because the new law left it ambiguous if all meals remain deductible. Details in the latest Voice for Real Estate news video from NAR. |

Issues Mobilization Grant Assistance in 2019
The first meeting of the 2019 NAR State and Local Issues Mobilization Support Committee is Wednesday, November 28, 2018, during the REALTOR® Party Training Conference in Minneapolis. In considering grant requests at this meeting, the Committee will be working with a new (2019) grants budget to assist 2019 issue campaigns. The GAD Professional Development Session will focus on a couple of topics: Campaign Finance Rules and Sign Ordinances. Specifically, we will take a deeper dive into sign ordinances and identify the pitfalls many localities are experiencing and ways to work with local government to allow for real estate signs, while adhering to the law. Work that Robinson & Cole has completed for NAR, assisting state and local REALTOR® associations with the post-Reed case, will be used as examples. How to write sign ordinances, including specific language, will be addressed.
